MINIMUM ENTITLEMENT TO ANNUAL LEAVE TO INCREASE TO 28 DAYS

Under the Working Time Regulations workers are entitled to four weeks paid annual leave (20 days) – pro rata for part-time workers. Employers have been free to decide whether or not to include the 8 bank holidays within this entitlement resulting in some workers receiving only 12 days annual leave plus 8 bank holidays.

The DTI has today announced that from 1 October 2007 workers will be entitled to 4.8 weeks (24 days) as a minimum entitlement and from 1 October 2008 this will increase to 5.6 weeks (28 days) ensuring that all workers will eventually be entitled to 20 days annual leave plus 8 bank holidays. Earlier indications had been that the increase from 4.8 weeks to 5.6 weeks would not take place until October 2009.
