NEW LAWS IN FORCE TODAY

 

The Sex Discrimination Act 1975 (Amendment) Regulations 2008 - effective 6 April 2008

The amendments to the sex discrimination law are now in force.  The amendments cover the following: 

  • elimination of the need for a comparator who is not pregnant or on maternity leave
  • causal link removed between harassment and the sex of the person enabling claims to be made by someone not subjected to the harassment himself or herself
  • now unlawful for an employer to fail to take reasonable steps to protect an employee from third party harassment 
  • changes to protection during additional maternity leave.

The Corporate Manslaughter and Corporate Homicide Act 2007 - effective 6 April 2008

The Act creates a new offence of corporate manslaughter/homicide that is proposed to overcome the current difficulties in seeking a conviction.
